Terms of Service
Last updated: 15 October 2026
These terms govern your use of Captus, an AI assistant for WhatsApp Business (the “Service”), operated by Captus Digital Solutions (“Captus”, “we”, “us”). By creating an account or using the Service, you agree to them on behalf of yourself and the business you represent (“you”).
1. The Service
Captus connects to your WhatsApp Business number through Meta's WhatsApp Business Platform and replies to your customers using the information you provide. It can also manage bookings and hand conversations over to you. We may improve or change features over time.
2. Your account
- You must give accurate information and keep your sign-in details secure.
- You are responsible for activity under your account and for the people you give access to.
3. Your responsibilities
- You must comply with WhatsApp's Business Terms, Business Messaging Policy and Commerce Policy, and with the laws that apply to your business, including data-protection and consumer laws.
- You are responsible for the business information you give the assistant (prices, policies, opening hours, etc.) being accurate and kept up to date.
- You must have a lawful basis to message your customers and must honour opt-out requests.
- You must not use the Service to send spam, or for any illegal, harmful, deceptive or abusive purpose.
4. AI-generated replies
Replies are generated by AI from the information you provide. We design the assistant to avoid inventing facts and to hand conversations to you when unsure, but AI can still make mistakes. You should monitor conversations, and you remain responsible for commitments made to your customers through your WhatsApp number.
5. Your data
You own your business information and your conversation data. You give us permission to process it only as needed to provide the Service, as described in our Privacy Policy.
6. Fees
Fees, if any, are agreed with you separately. WhatsApp conversation charges from Meta may apply depending on your setup.
7. Availability
We work to keep the Service running but don't guarantee it will be uninterrupted or error-free. It also depends on third-party services such as WhatsApp and Google that are outside our control.
8. Suspension and termination
You can stop using the Service at any time. We may suspend or end access if you breach these terms or WhatsApp's policies, or if required by law. After termination, we delete your data as described in the Privacy Policy.
9. Limitation of liability
To the extent permitted by law, the Service is provided “as is”, and Captus is not liable for indirect or consequential losses, lost profits, or losses resulting from AI-generated replies or third-party service outages. Our total liability is limited to the fees you paid us in the three months before the claim.
10. Changes
We may update these terms. We'll notify you of significant changes; continuing to use the Service means you accept them.
11. Governing law
These terms are governed by the laws of Malaysia.
